In car accident cases, the law has what’s called a threshold, meaning that; in order to receive pain and suffering damages, you have to show, within a reasonable degree of medical probability and certainty, that your injury is permanent. Now a doctor can give that opinion and testify that you have a permanent injury. The only way that you can recover pain and suffering damages in Florida is if a doctor does give that opinion. That can be pre-suit in the form of a medical report, or that can be a trail in the form of testimony in front of a jury.
